May 5, 2026 – A group has filed a federal discrimination charge against the nation’s largest teachers union, alleging systemic anti-Semitism and unlawful exclusion of Jewish members.
The Louis D. Brandeis Center Coalition to Combat Anti-Semitism announced it has submitted a complaint to the U.S. Equal Employment Opportunity Commission accusing the National Education Association of violating Title VII of the Civil Rights Act of 1964. The charge contends that the NEA, which represents more than three million educators nationwide, including Alaska, has allowed discriminatory practices and a hostile environment to take root within the union and its affiliated workplaces.
According to the filing, NEA policies and practices have limited the ability of Jewish members to participate fully in union governance, leadership opportunities, and professional development. The complaint alleges that internal classification systems categorize many Jewish members as “white,” effectively excluding them from certain diversity-based benefits and positions.
The Brandeis Center also claims that the NEA’s policies have contributed to a broader culture of harassment and intimidation. The complaint cites incidents at the union’s 2025 Representative Assembly, including reports that Jewish delegates were surrounded and shouted down by anti-Israel activists, and that references to a murdered Holocaust survivor were met with laughter and applause. It further alleges that security measures were reduced despite concerns raised by Jewish attendees.
Additional claims include that NEA materials removed Jews as the primary victims of the Holocaust and that a map distributed to members labeled Israel as “Palestine,” actions the complaint says contributed to erasing Jewish identity and fostering a hostile climate.
The filing argues that these conditions have had real consequences, with some Jewish educators leaving both the union and their workplaces due to what they describe as ongoing discrimination and intimidation.
Kenneth L. Marcus, chairman and CEO of the Brandeis Center and a former Assistant Secretary of Education, said the allegations reflect both legal and moral failures.
“Unions are supposed to protect their members’ rights. The NEA is actually violating them,” Marcus said in a statement, adding that the alleged environment extends beyond union meetings and into classrooms.
The Brandeis Center is asking the EEOC to investigate the claims, require the NEA to cease any unlawful practices, and implement corrective measures to ensure equal treatment for all members.

Those who continue to claim “legitimate criticism of Israel” without ever offering any legitimate criticism only further prove the point. There are a couple easy ways to tell when someone is offering legitimate criticism. First being that they actually offer legitimate criticism. Second they do not demonize Israel, think comparing Israeli policy to Nazis, claiming Israel is genocidal or apartheid while ignoring similar or worse actions by others. Third they do not apply double standards to Israel such as criticizing Israel and only Israel on certain issues, but chooses to ignore similar situations conducted by other countries. And they do not delegitimize Israel by denying the Jewish people the right to self-determination in their ancestral homeland. By challenging Israel’s fundamental right to exist antisemitic anti-zionists go far beyond legitimate criticizing of policies and show their true colors.
